IVC Filter Lawsuits - Cook MDL Settlement Conference Scheduled

One of the major defendants in the IVC filter is Cook Medical. Many Cook IVC filter cases have been consolidated in the Southern District of Indiana, since October 2014. U.S. District Judge Richard L. Young is presiding over this Multi-District Litigation (“MDL”). Lately, there has been an increase of cases in the MDL, going from 102 filings to 120 filings in about a month. Cook IVC filter cases continue to be filed in the MDL and throughout the country.

An important step for cases filed in the MDL is for bellwether trials to occur. Recently, several cases were submitted for bellwether consideration. The bellwether cases focus on two products: Cook Celect and Cook Gunther IVC filters.

Before the bellwether trials (scheduled for September 2016) occur, Judge Young has scheduled “settlement conferences” on certain cases from February 16th to the 18th 2016 in Indianapolis, IN. These cases will be chosen from a discovery pool. It will be worth keeping an eye on to see the results of these settlement conferences next February, which may have a great impact on whether the Cook MDL has early settlements or proceeds to an unknown number of bellwether trials.
