The Essure® product liability lawsuits filed in California have been coordinated in front of a single judge in Alameda County. The Judicial Council of California has created a Judicial Council Coordinated Proceedings (JCCP) in front of Judge Winifred Smith.
When cases that involve more than one common issue of fact or law are filed in more than one county in California, the cases may be transferred to a single court. The Essure® JCCP will preserve judicial resources and help facilitate efficiency in adjudicating these claims.
Bayer was opposed the petition for coordination filed by various Plaintiffs’; however, Judge Smith correctly held that a JCCP would plainly promote judicial economy and case management. Judge Smith went on to recommend that the coordinated proceedings be held in Alameda County.
This coordination is good news for Plaintiffs filed in California state court. The benefit of having one judge oversee all of the Essure® litigation will ensure consistent rulings across all coordinated cases. In addition, this JCCP will make the discovery process more efficient and allow all of these cases to move forward collectively.
