After the Food and Drug Administration (FDA) ordered C.R. Bard to conduct clinical trials on the Avaulta transvaginal surgical mesh, C.R. Bard was to prepare a study proposal for FDA approval. Instead, on July 1, 2012, C.R. Bard joined other transvaginal mesh manufacturers, such as Johnson & Johnson and Ethicon. On July 1, 2012, C.R. Bard stopped selling Avaulta transvaginal mesh in the United States.
C.R. Bard’s removal of Avaulta products from the market is too late for many women. Thousands of women have transvaginal mesh already implanted to treat pelvic organ prolapsed or stress urinary incontinence. C.R. Bard is also already having to defend its products in front of a judge and jury. A Washington State attorney represents 53 year old active runner Christine Scott. Ms. Scott’s running caused some weakening of the pelvic muscles resulting in a leaky bladder. Ms. Scott went to her doctor, who in 2008 implanted Bard’s Avaulta transvaginal mesh to treat the leaky bladder. Her doctor thought that Bard’s Avaulta transvaginal mesh would stop the urine leakage. Unfortunately, the transvaginal mesh caused Ms. Scott severe damages. The transvaginal mesh started cutting her colon and organs. For five months, she could only urinate with a catheter. She could no longer have sex with her husband. As a result of the transvaginal mesh, Ms. Scott has undergone eight surgeries to remove mesh and nine procedures to treat problems caused by the mesh. Ms. Scott even had to get counseling due to the emotional toll this transvaginal mesh caused. On Monday, a Kern County Superior Court jury awarded Christine Scott $5 million and her husband $500,000 for damages caused by C.R. Bard’s Avaulta transvaginal mesh.
This victory against transvaginal mesh manufacturers is not final, however. C.R. Bard intends to appeal the jury verdict. In the meantime, many other transvaginal meshes remain on the market.
